The Psychology of Judgment:
Most lawyers are trained in a law school advocacy model that is geared for lawyers and not for jurors. For jurors, your facts are not enough. Your experts are not enough. Your witnesses are not enough. And the law is not enough. You need a story, a narrative, and the ability to communicate that story in a simple and effective way that gives it meaning and helps the jury know exactly what they need to do with your case. Because the difference between information and meaning is the difference between losing and winning.
This seminar describes how the very model that most lawyers are trained in leads to reactive, convoluted, and self-defeating trial behavior. This seminar teaches lawyers four main methods to exponentially improve their advocacy skills by helping them find a case that has greater meaning for jurors and a judge, to help present that case in a clearer, simpler, and more impactful way, and to strategically position that case for a better result. It accomplishes this by teaching attorneys to:
- Redefine the jury
- Redefine the attorney’s role
- Redefine the trial story
- Redefine the trial
This seminar is a dynamic, interactive, and entertaining approach to shifting the way that you try cases. It is based on established social science and psychology about how jurors and judges actually make decisions in legal cases. It is based on Richard Gabriel’s experience in over 1,400 civil and criminal trials in over 40 states. It is based on his experience in some of the highest profile trials of our modern era: OJ Simpson, Casey Anthony, the recent Aaron Hernandez case, Phil Spector, Enron, and Whitewater.
