This conference on Mass Arbitration in PAGA, Wage & Hour & Consumer Class Actions and arbitration agreements for class actions is a gathering of legal experts who have given deep thought to the resolution of PAGA, Wage & Hour & Consumer Class Actions disputes through arbitration. The conference will focus on the use of arbitration agreements to resolve class actions, which have become increasingly common in recent years. Attendees can expect to gain insights into best practices, recent developments, and emerging trends in this area of law. Discussions will cover topics such as the enforceability of arbitration agreements, strategies for drafting effective agreements, and the implications of recent court decisions.

The program will cover a range of topics, including the benefits and drawbacks of arbitration, the use of experts and evidence in arbitration proceedings, and the enforceability of arbitration awards.

Attendees can also expect to learn about strategies for effectively arbitrating class action cases, including managing the pre-arbitration process, selecting an arbitrator, conducting class-wide arbitration hearings, and costs of mass arbitrations. In this half day program our faculty will explore the ins and outs of PAGA.  We will feature a review of recent PAGA Cases, learn how to draft PAGA letters and lawsuits as well as identifying issues worth pursuing under California ‘s Private Attorney General Act and discuss what is next for PAGA and PAGA cases. We will also look at the settlement of these claims and how best to set yourself up for productive settlement discussions.  We will conclude with tips for both sides on how to approach the settlement process and the most effective ways of documenting the settlement to obtain court approval.

There were several notable developments affecting class actions over the past year including the recent SCOTUS Viking River ruling. The Ninth Circuit again narrowly interpreted “public injunctive relief” under the McGill rule and issued significant decisions on class action settlement approvals. The Ninth Circuit also recently issued a significant en banc opinion regarding class certification issues in Olean Wholesale Grocery v. Bumble Bee Foods, — F.4th —, 2022 WL 1053459 (9th Cir. Apr. 8, 2022) (en banc), including the evidentiary burden for a plaintiff seeking class certification, the assessment of expert testimony at the class certification stage, and the interplay between Rule 23 and injury and Article III standing. The program will feature an update of Pending Cases in the 9th Circuit with some SCOTUS discussion, and several important technical issues required for bringing and defending class actions.
