On the heels of the Flo & Eddie v. Sirius XM Radio decisions in California and New York, which determined that Sirius committed copyright infringement under state law and engaged in unfair competition by publicly performing pre-1972 sound recordings, streaming music and content broadcasters need to readdress their production strategy. The decision has wide reaching implications and puts internet service providers, sites relying on user generated content, as well as traditional radio stations, at risk.
