One year into AB5 and following Proposition 22 California Employers and Litigators still wrestle how to classify independent contractors and employees and which employees are exempt. In Dynamex Operations West, Inc. v. Superior Court, the California Supreme Court has provided guidance in regards to independent contractor/employee classification with the adoption of the ABC test for determining how to classify an employee or independent contractor. Issues relating to exempt or non-exempt status of workers continues to be fertile ground for litigation in California. Litigating & Defending CCPA and Data Breach Cases is the third part in Bridgeport's Class Action Series. Data breach class action litigation has begun under the California Consumer Privacy Act (CCPA). The new California law authorizes a private cause of action against a covered businesses if there is a failure to implement reasonable safeguards to protect personal information results in a data breach. Businesses that collect or use personal information, do business in California and meet certain thresholds must know about the CCPA. The CCPA took effect January 1, 2020 and we will examine how the CCPA has already impacted consumer class action claims with major online businesses already having been sued for CCPA and Privacy cases.
